01Who we are & accepting these terms
Wivexx (“Wivexx”, “we”, “us”) is a visual studio and software brand based in Orlando, Florida, operating wivexx.com and related apps. By accessing or using any part of Wivexx, you agree to these Terms, our Privacy Policy, our Acceptable Use Policy, and our Copyright & DMCA Policy. If you do not agree, do not use Wivexx.
02Eligibility & age
You must be at least 13 years old to use Wivexx. Some content — including the “spicy” party-game deck — is intended for adults and requires you to be 18 or older. If you are under the age of majority where you live, you may use Wivexx only with the involvement of a parent or guardian.
03Your account
Some features require an account, which you access through a magic sign-in link sent to your email. You are responsible for activity under your account and for keeping access to your email secure. Let us know promptly of any unauthorized use.
04What Wivexx offers
- The studio service — photography, videography, and social content. Paid engagements are also governed by the separate written agreement we sign with you (e.g., session agreement, retainer, model release).
- Wivexx Studio — a planning and pre-edit canvas that connects to your own Google Drive.
- Wivexx Labs — games including Wraps, Impostor, Charades, Would You Rather, and Higher or Lower.
- Posts & deals — articles, updates, and offers we publish on the site.
We may add, change, or discontinue features at any time. The games and apps are provided for entertainment and convenience and may rely on third-party services that can change or become unavailable.
05Bookings & payments
Where you book a session or purchase a deal, the price, scope, deposits, cancellation, and refund terms are those stated at the time of booking and in any agreement we sign with you. Those terms control if they conflict with these Terms for that engagement.
06Your content & the license you give us
“Your Content” means anything you submit, upload, link, or create on Wivexx — posts, comments, canvases, files, and game inputs. You keep all rights you already have in Your Content. You grant Wivexx a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and process Your Content solely to operate and provide the services to you (for example, displaying a post, rendering a Studio export, or syncing a game room). This license ends when you delete Your Content, except for reasonable backups and where the law requires us to keep it.
You represent that you own or have the rights to Your Content and that it does not violate the law or anyone else’s rights. You are solely responsible for Your Content.
07Acceptable use
Your use of Wivexx must follow our Acceptable Use Policy. In short: nothing illegal, infringing, harmful, hateful, deceptive, or that abuses the service or other people.
08Third-party names, brands & game data
The Wivexx Labs games are unofficial and are not affiliated with, sponsored by, or endorsed by any third-party brand, franchise, company, or creator that may be referenced. Names of franchises, characters, creators, and companies are used purely for identification, commentary, and entertainment (nominative use). All trademarks, names, and likenesses belong to their respective owners.
The “Higher or Lower” game displays publicly available information and thumbnails obtained through the YouTube API Services. By using that game you also agree to be bound by the YouTube Terms of Service, and your information is handled per the Google Privacy Policy. If you are a creator and want your channel removed from the game, contact us and we will promptly remove it.
09Our intellectual property
The Wivexx name, logo, the Wivexx orb mascot, the original game designs and card art, original game decks and clue content, software, text, and the look and feel of the site are owned by Wivexx and protected by intellectual-property laws. You may not copy, modify, distribute, or create derivative works from them without our written permission. Game rules and mechanics are not claimed as proprietary; our original expression of them is.
10Wivexx Studio & Google Drive
If you connect Google Drive, you authorize Wivexx to access only the specific files and folders you choose (the drive.file scope). We use that access only to show, organize, and process the media you add to your canvases. We do not use your Google data to train models or for advertising. See our Privacy Policy for details, including our Google API Limited Use commitments.
11Wivexx AI
Some features generate automated output (for example, a brief or paper-edit). AI output may be inaccurate or incomplete; it is provided “as is” for your review and you are responsible for how you use it. Do not submit anything to AI features that you are not allowed to share.
12Disclaimers
Wivexx (other than paid services covered by a signed agreement) is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, secure, or error-free.
13Limitation of liability
To the fullest extent permitted by law, Wivexx and its owner will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the service. Our total liability for any claim relating to the free features of the service will not exceed USD $100; for paid engagements, the amount you paid for that engagement.
14Indemnification
You agree to indemnify and hold harmless Wivexx and its owner from any claims, damages, and expenses (including reasonable legal fees) arising out of Your Content or your breach of these Terms or the law.
15Suspension & termination
We may suspend or terminate your access at any time if you violate these Terms or the Acceptable Use Policy, or to protect the service or other users. You may stop using Wivexx at any time.
16Changes to these terms
We may update these Terms from time to time. Material changes will be reflected by the “last updated” date above, and continued use after changes means you accept them.
17Governing law
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Orange County, Florida, and you consent to that jurisdiction.
